Il est institué par la loi N° 91-007 du 25 février 1991 portant charte de la jeunesse en République du Bénin et dispose des prérogatives dévolues aux structures similaires dénommées : « Conseil National de la Jeunesse (CNJ) » dans certains pays africains et du monde. L’OCJ jouit d’une personnalité juridique. C’est une structure démocratique, apolitique et autonome.
