CIVIC SPACE The Quarterly Learning Brief for CSO Partners in Bor, Jonglei State  1. Introduction The objective of the NPA’s civil society project in Jonglei state is to strengthen the operational and institutional capacity of civil society organizations in Bor to play an important role in supporting communities to organize and make their voices heard to ensure that their needs and priorities are known to and met by policy makers. The overall aim of the project is to bring about positive change and impact in the lives and well-being of communities that NPA civil society partners serve and represent in Jonglei state. This quarterly learning brief will focus on the contextual definition of civic space, the main challenges confronting civil society organizations (CSOs) in Jonglei state in claiming and exercising their civic space, and how these CSOs have responded and adapted to these challenges in claiming, and exercising their rights to freedom of expression, association and peaceful assembly in Jonglei state, South Sudan.   2. Definition of civic space In August 2018, NPA conducted a quarterly peer learning forum on civic space involving 30 participants (20 males, 10 females) from six CSO partners in Bor to promote a good understanding of the value of a strong healthy civil society and to encourage a good relationship between civil society, the public and state authorities. The quarterly learning forum defined civic space as the ability, right and freedom by CSOs in Jonglei state to associate, assemble and express views and opinions, freely and peacefully, on issues that matter to the needs and priorities of the communities of Jonglei state.  The quarterly forum also highlighted the importance of civic space in democratic transformation of Jonglei state as it enables citizens and civil society organizations to organize, participate and communicate without hindrance and thus be able to claim their rights and influence the political and socioeconomic realities around them. Therefore, the quarterly forum commenced with a clarion call to the state government to uphold its constitutional mandate and duty to protect citizens, and respects and facilitates their fundamental rights to freedom of association, freedom of expression, and freedom of peaceful assembly.  3. Challenges in claiming civic space This demand from CSOs came against a backdrop of major challenges facing CSOs in Jonglei state in form of shrinking operating space following the stricter and harsher enforcement of the NSS laws in Bor. Thus, there is weak legal protection of CSO activists who are under constant threat of harassment, intimidation, detention and violence. The forum noted that citizens and members of the CSOs in Jonglei state have lost their ability and rights to gather publicly and collectively express, promote, pursue and defend their common interests and that of the wide communities in the state. Moreover, the forum decried the curtailment of their rights to access information, of their freedom to speak out against bad state policies and actions, and of their ability to publicly advocacy and campaign in promotion of the needs and priorities of the communities, without fear of retribution from the state. Secondly, CSOs are facing constrained socio-political and cultural environment in Jonglei state in which opportunistic politicians and traditional authorities exploit social and cultural conservatism in the community to restrict and curtail women rights, and other contested issues pertaining to customary laws in order to delegitimize CSOs’ advocacy work on human rights, democracy and accountability. Furthermore, CSOs have been experiencing limited or restricted access to policy makers and structures, often characterized by manipulation and co-optation of the CSOs by state actors, which hamper their advocacy work on democratic governance, accountability and human rights. More crucially, shrinking funding opportunities for CSOs, coupled with limited domestic avenues for fundraising, have further reduced the ability of CSOs to claim and exercise their civic space in Jonglei state. Nonetheless, the forum stressed the fact that the state government is not necessarily opposed to everything being undertaken by CSOs in Jonglei state. For instance, state government tends to wholeheartedly welcome and champion the work of CSOs when those CSOs confine themselves to deliver much needed basic services, support developmental projects and actively engage in social welfare and charitable activities in the rural communities. State government become more antagonistic and intolerant when CSOs seek to advance and promote civil and political rights, more democratic governance and more transparency and accountability in the state, which the state government tend to view and portray as a direct challenge to their rule by non-state actors, purportedly on the payroll of hostile foreign governments. 4. Innovative strategies to claiming civic space Therefore, CSOs have adopted various innovative strategies to claim, increase and maintain their usage of shrinking civic space in Jonglei state. While some CSOs have responded by strengthening their local constituencies and presence to build and expand constituency support, others have adjusted their activities by directly relating human rights work to service delivery and community development, an innovative strategy that have expanded access to policy makers and policy dialogue. Other CSOs have refocused their efforts to building alliances, bigger networks and platforms with other CSOs to seek safety and effectiveness in numbers. Finally, some CSOs are relying on evidence-based research and advocacy to build support and leverage with the state and community leaders in order to frame and influence public debate, opinion and policy making processes in the state.  4. Conclusion With the signing of the revitalized peace agreement (R-ARCSS), CSOs and citizens are upbeat about a prospect of increasing and maintaining their civic space in Jonglei state. They are confident and hopeful that the revitalized transitional government of national unity (R-TGONU) will be more tolerant and supportive of citizens and CSOs exercising and promoting their fundamental rights to freedom of association, freedom of expression, and freedom of peaceful assembly in serving and representing the needs and interests and priorities of their members and the wider communities of Jonglei state.   Policy Brief on CSOs Contribution to Policy Development in Jonglei state The 2nd Quarterly Learning Forum for CSO Partners in Bor, Jonglei State November 28-29, 2018, Ariop Hotel, Bor (1) Introduction The objective of the quarterly learning forum for the civil society organizations’ partners in Bor, Jonglei state, is to promote a good understand of the value of a strong healthy civil society and to encourage a good relationship between civil society, the public and state authorities. The first civil society learning forum was conducted in August 2018. The chosen theme of the discussion was on the main challenges confronting civil society in Jonglei state in claiming and exercising their civic space, and how these CSOs have responded and adapted to these challenges in claiming, and exercising their rights to freedom of expression, association and peaceful assembly in Jonglei state, South Sudan.   The second quarterly learning forum for CSO partners in Bor was conducted in November 2018 and three themes were chosen for the two-day learning forum. The first theme was on how civil society organizations (CSOs) can contribute to policy development processes at state level e.g. an understanding on the policy making process; an overview of window of opportunity to participate; elements of lobbying and advocacy, and evaluation of the policy influencing interventions. The second theme was on leadership and public accountability such as the role of government and CSOs in promoting good governance and the rule of law; areas and element of collaboration between the civil society and government on public accountability matters; experiences and opportunities to open space for public accountability and the need for a strong/united and a good relationship between the state and CSOs.  The last theme was on the current and potential role of CSOs in light of the changing context, for example, the process of localization; the shift from relief to development; returnee livelihoods and the pressure on the environment, and what CSOs can do to mitigate the challenges and policy advocacy on key priorities of the poor? The learning forum was facilitated by Makwei Deng from NPA and Michael Kamya from ZOA. Two presentations were made by two representatives from the government on policy development and budget making process at the state level. The first one was from the Jonglei state government comptroller on the budget making process which was followed by a focused group discussion among, and presentation by, the participants on the roles of the civil society in the allocation of resources at the state level. The second presentation was the role of CSOs in leadership and policy making at the state level, which was also followed by a focused group discussion among, and presentation by, the participants.  The final presentation was from the facilitators and it dealt with the current and potential role of CSOs in light of the changing context in South Sudan in general and Jonglei state in particular. It focused on policy and process of localization, the shift from relief to development, the returnee livelihoods and the pressure on the environment, and what the civil society organizations in Jonglei state can do to mitigate the challenges and policy advocacy on key priorities of the communities of Jonglei state.  Below is a consolidated note from the two-day event: (2) Presentation from the State Government Comptroller: Budgeting Process •\tParticipatory planning processes; different stakeholders e.g. CSOs along with legislators, auditors, the media, and the broader public •\tRevenue budget: resource envelope prepared by the ministry of finance; this is then presented to all the gov’t agencies.  •\tFinancial/fiscal year: financial calendar; plans made based on timeframe (often 1st July each year to 1st June). •\tExpenditure budget; salary, capital; forwarded to the council of ministers, then onward to the national assembly. Then it is ascended to by the governor, president. \tRealistic budget. \tDrawing strategic priorities. \tCompetency of budgeting committee. \tEnsure value for money is achieved. \tUse of centralized system. \tIntegrated financial management system. \tBudget performance report. •\tGazettement. •\tQuantification of output. •\tSemi-annual and annual review of supplementary budget. •\tParticipatory planning. •\tMonitoring; to ensure that the budget is appropriately executed. (3) Role of CSOs in budgeting in Jonglei state: •\tContribute critical information on the public’s needs and priorities that can lead to stronger policy choices; •\tDraw more people into the debate by collecting, summarizing into easily understandable formats, and spreading budget information; •\tTrain members of the public to understand and analyze government budgets themselves; •\tSupplement government’s capacity to budget effectively by providing technical support; •\tGive an independent opinion on budget proposals and implementation; •\tHold public officials accountable for using public resources efficiently and effectively to achieve desired outcomes; and •\tDevelop important new allies in government, including program managers in government agencies, legislators, and auditors. (4) Understanding Jonglei State Taxation Process: \tBudgeting is mainly undertaken by state revenue authority and ministry of finance. \tThey oversee the policy formulation process. \tHarmonisation of taxes throughout the state e.g. land fees, rent rates. \tDeliberation of state council of ministers on the main items to be assessed for taxation. \tIf endorsed, a document of approval is then forwarded to the state legislative assembly who would then debate on the contents of the document. \tOnce approved, it is passed to legal administration. \tThe final step in the budgeting process occurs when the state governor ascends to the bill and signs it into law. (5) Elements of taxation \tCommunity is entitled to a percentage/share of the spoils. \tLocal service tax is derived from bomas, payams, counties and states. \tMajor government priorities; these principally consist of salaries, operation and construction. (6) Focused Group Discussion: Question and answer session: 1.\tDetermination of the budget ceiling by the government. 2.\tHow does the government decide on budgetary priorities? 3.\tWhat are the sources of funds that the government refund borrowed resources? 4.\tWhere do the government departments take funds that may not have been used? 5.\tDoes the government have budget execution report? FGDs: Presentation from the CSO partners 1.\tHow can CSOs contribute toward budget allocation? •\tIdentification of gaps via lobbying. •\tConsultation meetings. •\tBudget conferences or workshops. •\tPublic awareness /sensitization of the budget. •\tSensitization of public about the audit report. •\tMonitoring and evaluation of the fiscal year. •\tYearly feedback and recommendation from the community.  2.\tRoles of CSOs in resource allocation process: •\tAdvocacy. •\tPublic accountability. •\tCivic education on resource allocation. •\tPolicy influence.  3.\tHow can CSOs contribute to budgeting process? •\tVoice their concern against misuse of funds. •\tProper implementation of budget work plan. •\tAdvocate for independent budget committee. •\tInvolvement of CSO financial experts in budgeting. •\tAdvocate for budget accountability e.g. public expenditure management. •\tCSOs bring new information to budget decision-making committee. •\tSimplifying the budget and depending debate. •\tTraining; developing budget expertise. •\tProvide recommendations to the government for improvement. •\tSharing of information. •\tConduct strategic research studies to establish facts on budgetary requirements. •\tCreate value for money. •\tDevise policies for structured development. (7) Major challenges to appropriate budgetary processes: \tLine ministries not tracking relationships between CSOs and funding agencies. \tCSOs hardly access the authorities. \tPersonal interests override (8) The role of CSOs in leadership and policy making \tCivil society organizations participate in policy development via identification, prioritization of key issues and implementation of policies. \tCSOs do not directly monitor or evaluate the policies; they influence policy makers & policy making. \tThis may involve sharing of constructive ideas in helping in the implementation of projects outlined and funded by funding agencies e.g. Norwegian People’s Aid (NPA). \tCSOs’ sole responsibility revolves around representation of people’s interests, often achieved by filling gaps and complimenting government’s efforts. \tCSOs support peacebuilding initiatives and help the government implement peace, thereby reducing high political volatility, uncertainty and stamp out the wide sense and deep mistrust within the society toward public authorities. \tCSOs are a conglomerate of strategic partners, including; labour unions and non-profit organizations such as the faith-based groups. \tCSOs advocate for good governance by holding the government accountable for its actions in the interest of common man. \tFoster political sensitivity, holistic vision and technical complexity. \tLegal factors: the constitutional framework and the role of customary law. \tEconomics: availability of natural resources, infrastructure, investment conditions and available capital to fund grassroots initiatives/programmes. \tAdvocate for disadvantaged or marginalized/minority groups e.g. women, youth & disabled. (9) Emerging Issues \tChanging context of relief work; major emphasis to be placed on phasing out relief work and embark on sustainable development. Leap from humanitarian work being undertaken by international organizations to local/national organizations. \tRepatriation/resettlement programme: support for returnees. \tEnvironmental restoration. \tContinued engagement on advocacy. \tCSOs to focus mainly on sensitization of local populace about major issues e.g. peacebuilding and/or combination of peace, relief and development. (10) Nexus approach \tAvoid exploitation of environment: training locals on safe environmental practices; this may be achieved by building of wood-saving stove which uses minimal firewood and use of biogas. \tAgroecology: seedlings, animal husbandry. \tDiversification of farming activities. \tInvolvement of civil society organizations in repatriation. \tRehabilitation: renovation of shattered physical infrastructures such as schools, hospitals. \tOffer psychosocial support to returnees. This also encompasses reintegration of former members of militias. \tCollaboration among different CSOs to conduct widespread civic education on peacebuilding initiatives. \tReconstruction of fragmented social units e.g. reunification of families. \tSecurity sector reforms: this may both be internal or external. \tCapacity-building on income generating activities such as food security and livelihood. \tCommunity ownership of the project (11) Conclusion: Annual Awards to the Best CSOs Finally, certificates of awards were given to the most outstanding civil society organizations in Bor to recognize their achievements and amplify their voices among the communities of Jonglei state. Eight annual awards were given based on the following criteria: The Best Advocacy Organization under the CSF project in Bor, Jonglei state, 2018; The Best Youth Organization under the CSF project in Bor, Jonglei state, 2018; The Best Media Organization under the CSF project in Bor, Jonglei state, 2018; The Best Women Organization under the CSF project in Bor, Jonglei state, 2018; The Best Humanitarian Organization under the CSF project in Bor, Jonglei state, 2018; The Best CSO with strong internal democratic structures and good governance practices under the CSF project in Bor, Jonglei state, 2018; The Best CSO with strong internal systems for accountability and financial management under the CSF project in Bor, Jonglei state, 2018, and The Best CSO with the capacity to influence positive change at both local and national levels under the CSF project in Bor, Jonglei state, 2018.
